Cemeteries Announcements
Update on the Cemeteries Act and Requirements:
On July 1, 2026, HB 1254 becomes law. This law:
- Dissolves the State Board of Cemeterians.
- Strengthens oversight of perpetual care trust funds and preneed escrow accounts.
- Requires cemetery owners to maintain written business continuity and succession plans.
- Restricts improper investment of trust funds, and allows court ordered asset seizure if required funds are not maintained.
- Creates a five-member Cemeterian’s Advisory Group to provide nonbinding guidance.
At this time, the Division is beginning to search for parties to be on the Cemeteries Advisory Board. All interested candidates are asked to submit the following:
