Adopted Board Policies
Applications will be approved administratively once all criteria as outlined in the law and Board rules have been met. The Board will review any applicant with an affirmative answer to the conviction or Board sanction question. Administratively issued licenses are considered for a vote to ratify at the next regularly scheduled board meeting.
An applicant must satisfactorily complete all requirements for licensure within one year from the date of receipt of the application. Incomplete applications are void, and the applicant must submit a new application with the required fee.
The Board has approved one Board member to work as the CE reviewer on behalf of the Board and approve or deny all CE programs. This reviewer abides by the appropriate Board Rule in this review process. All licensees who renew during the late renewal period, after December 31 of odd numbered years and before March 31 of the following year, will be required to submit CE’s for review by the Board
The Board has approved one Board member to work as cognizant on behalf of the Board and review disciplinary matters. All cases reviewed by the cognizant are eventually brought before the Board for a vote of resolution.
Lapsed dealers (after 12/31/of the even-numbered years) must reinstate with a reinstatement application and late renewal fee of $240. If they have operated since the lapsing of the license, they must be reinstated under a Consent Order with the $240 late renewal fee as well as a fine imposed by the Board.
If the Board receives written notice of the closure or sale of an active licensed dealership, the administrative staff will change the dealerships license status from active to “Facility Closed”. If notice of the closure or sale is never received from the license holder for the dealership, and it is determined through a new applicant for the same physical location or by any other means that the dealership has been closed or sold, the administrative staff is to change that dealer license from active to “Abandoned”.

Discussion regarding a Board policy, to be effective this date, for applications for dealerships and/or dispensers where the determination of a period of unlicensed practice has occurred, the following fine scale is implemented and enforced through a public Board Order: • For unlicensed practice up to six (6) months, $500; for unlicensed practice of seven (7) to twelve (12) months, $1000; and for each additional month of unlicensed practice determined over twelve (12) months, $500 per month. In addition, the license is not to be issued until the Board Order is signed and docketed, and the fine amount determined has been paid.
